Welcome to the digital platform, programs, and services operated by Claude Fourie ("we," "us," "our," or "Provider"). These Terms of Use and Conditions of Service ("Terms") govern your access to and use of our website, digital content, and professional offerings, including but not limited to the Rekindle Intimacy Program, the Self-Help Short Courses, and individual or coupled Consulting Services (collectively, the "Services"). By purchasing, enrolling in, accessing, or otherwise interacting with any part of our Services, you ("Client," "User," or "you") agree without limitation or qualification to be bound by these legal Terms. If you do not agree to these Terms, you are strictly prohibited from using or accessing our Services.
CLAUDE FOURIE IS NOT A MEDICAL PRACTITIONER, LICENSED PHYSICIAN, PSYCHIATRIST, CLINICAL PSYCHOLOGIST, LICENSED MARRIAGE AND FAMILY THERAPIST (LMFT), OR LICENSED CLINICAL SOCIAL WORKER (LCSW). CLAUDE FOURIE MAKES NO CLAIMS OF ANY MEDICAL, CLINICAL, OR MENTAL HEALTH QUALIFICATIONS, LICENSURES, MEDICAL TITLES, CLINICAL EXPERTISE, OR CLINICAL EXPERIENCE.
The information, frameworks, strategies, and materials provided through the Services are intended solely for educational, informational, self-help, and motivational purposes. They do not constitute, and must never replace, professional medical advice, clinical diagnosis, psychiatric evaluation, psychological treatment, or therapy. Always seek the advice of your physician or other qualified health provider regarding any medical or mental health condition.
1. SCOPE OF SERVICES OFFERED
The Services provided under these Terms are segmented into distinct educational and consultative tracks. Your legal rights and obligations vary depending on the specific track you purchase or access:
* Rekindle Intimacy Program: A structured multi-week digital or hybrid curriculum focused on relational resetting, communication development, and intimacy architecture.
* Self-Help Short Courses: On-demand, self-paced, single-topic modules (e.g., sexual communication, overcoming overthinking, navigating desires under medication, individual discovery) hosted behind a secure paywall.
* Consulting Services: Live, scheduled 1-on-1 or couples educational consulting, mentorship, or coaching sessions delivered via video conference or telephone.
2. ELIGIBILITY AND AGE RESTRICTIONS
Due to the adult nature of the topics discussed, including human sexuality, relationship mechanics, and anatomical pleasure, you must be at least eighteen (18) years of age (or the age of majority in your jurisdiction) to purchase, enroll in, or access any Services. By accessing the Services, you represent and warrant that you meet this age requirement. If we discover that any user is under 18, we will terminate their access and delete their data immediately without liability or refund.
3. NATURE OF RELATIONSHIP: NON-THERAPEUTIC AND NON-CLINICAL
You explicitly acknowledge and agree to the following conditions regarding your interaction with Claude Fourie and the Services:
* No Professional-Client Privilege: No doctor-patient, therapist-client, or privileged clinical relationship is created by your use of the website, courses, programs, or consulting services. Your communications with Claude Fourie are treated with high operational privacy but do not carry statutory evidentiary privileges applicable to medical or legal professionals.
* No Assessment or Crisis Management: The Services are not a crisis intervention resource. If you are experiencing psychological distress, relational safety issues, trauma responses that require clinical intervention, or thoughts of self-harm, you must immediately contact an emergency medical service or a licensed clinical provider. We do not provide mental health assessments or crisis services.
4. FINANCIAL TERMS, SUBSCRIPTIONS, AND CANCELLATION POLICIES
4.1 Fees and Payment All fees for the Rekindle Intimacy Program, Self-Help Short Courses, and Consulting Services are stated in U.S. Dollars (USD) and must be paid in full or via an authorized payment plan before access is granted. Payments are processed securely via third-party providers (e.g., Stripe, PayPal via Wix).
4.2 Subscription Billing and Gated Access Certain Self-Help Short Courses may be offered via an all-access paid monthly or annual subscription. Subscriptions automatically renew at the end of each cycle unless canceled in writing or through your user portal prior to the renewal date.
4.3 Refund and Cancellation Policy
* Digital and On-Demand Content (Short Courses): Because digital access is granted instantly upon purchase, all sales of online courses and digital downloads are final and strictly non-refundable. You waive any "cooling off" period under local consumer protection rules once digital delivery has begun.
* Rekindle Intimacy Program Exception: Notwithstanding the above, the Rekindle Intimacy Program includes a limited forty-eight (48) hour refund window. If, within exactly 48 hours of completing your initial payment for the program, you determine that the curriculum does not align with your goals, you may submit a written refund request. Upon approval, your access will be revoked and a refund issued. Once this 48-hour window has elapsed, all fees for the Rekindle Intimacy Program become strictly non-refundable.
* Consulting Services: Scheduled 1-on-1 or couples consulting sessions must be canceled or rescheduled at least twenty-four (24) hours in advance. Failure to provide 24 hours' notice will result in the forfeiture of the session fee, and no refund or makeup session will be issued.
5. ABSOLUTE LIMITATION OF LIABILITY & INDEMNIFICATION
5.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE UNITED STATES LAW, CLAUDE FOURIE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND RESULTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE, OR THAT INTUITIVE RELATIONAL SUCCESS IS GUARANTEED.
5.2 Limitation of Damages
UNDER NO LEGAL THEORY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, SHALL CLAUDE FOURIE, HIS AFFILIATES, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, EMOTIONAL DISTRESS, RELATIONAL RIFT, DIVORCE, SEPARATION, LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. IN NO EVENT SHALL THE TOTAL LIABILITY OF CLAUDE FOURIE EXCEED THE EXACT AMOUNT PAID BY YOU TO CLAUDE FOURIE FOR THE SPECIFIC SERVICE CAUSING THE CLAIM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
5.3 Client Responsibility and Release You assume full, unilateral responsibility for any changes you implement in your relationship, sex life, lifestyle, health habits, or personal routines as a result of using these Services. You hereby release, acquit, and forever discharge Claude Fourie from any claims, demands, damages, or causes of action arising from emotional discomfort, partner disagreements, physical injury, or psychological adjustments experienced during or after participation in the courses or consulting.
5.4 Indemnification You agree to defend, indemnify, and hold harmless Claude Fourie and his representatives from and against any third-party claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or any actions taken by your romantic or sexual partners as a cross-consequence of your participation in the Services.
6. INTELLECTUAL PROPERTY & ACCEPTABLE USE LICENSE
All materials provided within the Rekindle Intimacy Program, Self-Help Short Courses, and Consulting tracks—including videos, downloadable worksheets, texts, diagrams, audio guides, communication templates, and unique frameworks—are the exclusive intellectual property of Claude Fourie and are protected by United States and international copyright, trademark, and trade secret laws. Upon enrolling, you are granted a single, non-exclusive, non-transferable, revocable license to access and view the materials for your personal, non-commercial use only. Under this strict license, you agree that you will not: * Copy, record, screenshot, download (unless explicitly permitted), modify, or reverse-engineer the content. * Share your login credentials or allow third parties (other than your single designated romantic partner, where explicitly authorized in writing) to view or use the content. * Resell, republish, or distribute any content to public forums, social media channels, or competing educational platforms.
7. PRIVACY, DATA SECURITY, AND CONFIDENTIALITY
We respect the sensitive, intimate nature of the topics you explore through our Services. Your privacy is protected under the following operational guidelines:
* Data Handling: We utilize standard administrative and technical safeguards (secure hosting, encrypted checkout portals) to secure your account data. However, you acknowledge that no digital transmission over the internet is 100% secure.
* Consulting Privacy: Content discussed during live Consulting Services is kept strictly confidential between the Client and Claude Fourie, subject to standard legally mandated exclusions in the United States (e.g., clear, imminent intent to cause harm to yourself or an identifiable third party, or suspicion of child/elder abuse).
* Member Content Rules: If our digital programs include community forums or member groups, you are strictly prohibited from recording, sharing, or publishing any personal stories or identifying information disclosed by other participants. Maintaining a safe space is a core material term of this contract.
8. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION

These Terms, your access to the Services, and any legal disputes or claims arising between you and Claude Fourie shall be governed by, interpreted, and enforced in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
You explicitly agree that the Western Cape High Court (Cape Town Seat) or the Magistrates' Court otherwise having jurisdiction shall have exclusive jurisdiction to hear and determine any legal proceedings, litigation, or disputes arising out of or in connection with these Terms or the Services.
For international clients accessing the Services from outside South Africa (including the United States): You waive any right to claim that this forum is inconvenient or that a local, non-South African court has jurisdiction over Claude Fourie. To the maximum extent permitted under applicable law, you waive any right to bring or participate in class-action lawsuits or group arbitration against the Provider.
9. SEVERABILITY AND COMPLETE AGREEMENT
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. These Terms constitute the entire legal agreement between you and Claude Fourie regarding your use of the Services, superseding all prior oral or written representations, marketing promises, or informal communications. Acknowledgment by Client: By checking the "I Accept" box at checkout, entering your billing data, purchasing any plan on this site, or entering into a consulting engagement with Claude Fourie, you formally certify that you have read, fully understood, and explicitly consented to all sections of these Terms of Use, with specific emphasis on the Medical Disclaimer (Section 3) and the Limitation of Liability (Section 5).
